How To Make A Bicycle Crash Claim

When making a claim, you could claim for up to two different types of compensation: general and special damages. General damages compensate you for any physical or mental damages that you may have incurred. Special damages cover financial costs, such as loss of income or medical expenses, caused by the injury.

In order to make a bicycle crash claim, it would be advisable to get as much evidence as possible. If possible, the best kinds of evidence to collate include; CCTV footage, witness accounts and medical reports. Having this before contacting a solicitor could make building your case much easier and potentially more likely to have a chance for success.

Bicycle crash claims can be made with the help of a personal injury solicitor, such as the ones on our specialist panel. It is always best to get legal advice as soon as possible after an accident, which can be done today by getting in touch with us.

You should know that your solicitor does not need to be situated near you but can be based anywhere in the country, as long as they have the requisite experience.

Common Types Of Bicycle Crash Injuries

There are many different ways you could be injured in a bicycle crash accident. These include:

However, this list is not exhaustive, and you could still have a valid claim if you have some other form of injury. It’s always advisable to get a professional diagnosis after an accident.

Different types of injuries will equate to different amounts of compensation in a valid claim. See our calculator compensation table further on in this guide to see how much you could be awarded.

Common Causes Of Bicycle Crashes

Bicycle crashes can happen in a multitude of ways. It could be that another vehicle was speeding and knocked you off your bike. You could have been riding along a winding country road, with all the appropriate safety gear, but a car has driven recklessly round a corner and caused a collision. You may have been cycling appropriately and a driver crashed into you because they didn’t look when turning out of a junction.

These are just a few examples. Even if you don’t see your specific circumstances here, you could still be able to make a valid bicycle crash claim providing it wasn’t your fault. Each case is judged individually according to the specific circumstances. For more information or to make a claim, get in touch with us.

What To Do If The Other Party Didn’t Stop

In a normal accident, the driver’s insurance company will be held liable to cover the costs. However, if the other party is untraceable or uninsured, there are still ways you can make a claim.

The Motor Insurers’ Bureau (MIB) can help you with this. They are an independent body funded by insurers, and they can help you if the other party didn’t stop or wasn’t insured. To claim through the MIB, you must first make reasonable efforts to locate the driver yourself. To do this, you could:

  • Report to the police (in order to claim through the MIB you’d always need to report the accident to the police)
  • Note the make, model and registration plate on the car
  • Ask witnesses

If you take these steps, but you still can’t identify the driver, you could still make a successful claim through the MIB. A solicitor could support you with this.

What To Do After A Bicycle Crash

As aforementioned, it is always important to seek medical attention after being in a crash. Although you will be invited for a medical assessment as part of your claim, it is key to have records from as soon as possible after the accident in order to be able to show the extent of damage done at the time, not just at the time of making the claim.

It’s important to note that compensation amounts are often calculated according to the extent of the damage, so to get an accurate estimate on how much you could be owed, your solicitor needs all the information about your injury.

Other types of evidence could include (but are not limited to):

  • Photographs of the scene and your injuries
  • CCTV footage
  • Accident report records
